Set out in the Developmental Disabilities Assistance and Bill of Rights Act (DD Act) (P.L. 106-402).

The governor shall select members of the council, at his or her discretion after soliciting recommendations from organizations representing a broad range of individuals with developmental disabilities and individuals interested in individuals with developmental disabilities, including the non-state agency members of the council.

The governor shall make appropriate provisions to rotate the membership of the council. The council shall include representatives of the principal state agencies. Not less than 60 percent of the membership of the council shall consist of individuals with developmental disabilities; parents or guardians of children with developmental disabilities; or immediate relatives or guardians of adults with mentally impairing developmental disabilities who cannot advocate for themselves; and not employees of a state agency that receives funds or provides services under this part, and who are not managing employees (as defined in section 1126(b) of the Social Security Act).

Entity Powers and Duties, Activity Summary
Carry out responsibilities in P.L. 106-402 to ensure that people with developmental disabilities and their families receive the necessary supports/services to achieve increased independence, productivity, self determination, integration and inclusion in the community.

ACTIVITY SUMMARY

To carry out the mandates of P.L. 106-402:

  • Implement the five-year state plan that is the basis of systemic change, capacity building, and advocacy activities that increase the independence, productivity, self-determination, and integration and inclusion of people with developmental disabilities and their families into the community
  • Increase public awareness and knowledge about developmental disabilities through training, inter-agency meetings, public education, and technical assistance
  • Provide, administer, and evaluate federal grants based on the goals contained in the five year state plan
  • Review and comment on federal and state plans, existing laws, proposed legislation, and administrative regulations
