Membership includes

  • four public members one of whom must be a person who either is receiving home care services or has received home care services preferably within the five years prior to initial appointment, one of who must be a person who has or had family member receiving services preferably within five years prior to initial appointment, one of whom must be a person who either is or has been a resident in an assisted living facility preferably within the five years prior to initial appointment, and one of who must be a person who has or had a family member residing in an assisted living facility preferably within the five years prior to initial appointment. 
  • two Minnesota home care licensees representing basic and comprehensive levels of licensure - may be managing official, administrator, supervising registered nurse, or an unlicensed personnel performing home care tasks;
  • two Minnesota assisted living licensees representing assisted living facilities and assisted living facilities with dementia care levels of licensure who may be the facility's assisted living director, managerial official, or clinical nurse supervisor,
  • one organization representing long-term care providers, home care providers, and assisted living providers in Minnesota, and
  • one member of the MN Board of Nursing;
  • one member representing the Ombudsman for Long-Term Care;
  • one member representing the Ombudsman for Mental Health and Developmental Disabilities;
  • one member representing County Health and Human Services or Adult County Protection; and 
  • one organization representing of a consumer advocacy organization representing individuals receiving long-term care from licensing home care providers or assisted living facilities.

  • Per Diem: $55.00
  • Other Compensation: Parking fees and mileage. Board of Nursing and Ombudsman representatives do not qualify for per diem or other compensation.

Entity Powers and Duties, Activity Summary

The council will provide advice regarding regulations of the home care providers including community standards; enforcement of licensing standards and disciplinary actions; distribution of information to providers and consumers; training standards; emerging issues; and other duties as directed by the commissioner.

The Council provides information, guidance and recommendations to MDH about regulations for licensed home care providers including:

Community standards
- Enforcement of licensing standards and disciplinary actions
- Distribution of information to providers and consumers
- Training and technical assistance needs
- Emerging trends and concerns
- Other tasks directed by the Department


The advisory council shall make recommendations annually to the commissioner for the purposes of allocating the appropriation in sections 144A.474, subdivision 11, paragraph (j), and 144G.31, subdivision 8. The commissioner shall act upon the recommendations of the advisory council within one year of the advisory council submitting its recommendations to the commissioner. The recommendations shall address ways the commissioner may improve protection of the public under existing statutes and laws and improve quality of care. 

ACTIVITY SUMMARY

The Home Care and Assisted Living Program Advisory Council reviewed and recommended legislative changes to home care laws to assist providers and provide better health care to Minnesotans.  The council also makes annual recommendations to the Commissioner of Health.

As of 08/27/2025 the uncommitted balance in the Advisory Council budget string is $4,926,780 The portion of the uncommitted balance for Home Care is $1,471,462 and for Assisted Living: $3,455,318 The average annual collection of fines is $123,000 for Home Care and $993,000 for Assisted Living. Expenses incurred of $6101 are related to staff hours provided to support the Council.
